*Liability Waiver for Resort Under Construction*
In consideration of being allowed to enter and utilize the premises of Sedona Views Bed & Breakfast, located inSedona, Arizona, including but not limited to the rooms, creekside area, and hiking trails (the "Premises"),while the resort is under construction, I/we, the undersigned guest/s, acknowledge and agree to the following:
1.*Acknowledgment of Construction Status*: I/we understand that the Premises are under construction and may pose hazards, including but not limited to uneven terrain, construction materials, and potential water hazards.
2.*Resort's Safety Efforts*: I/we acknowledge that Sedona Views B&B is making reasonable efforts to maintain a safe environment, including but not limited to providing warnings, signage, and safety measures.However, I/we understand that these efforts do not guarantee my/our safety, and I/we assume full responsibility for my/our well-being while on the Premises.
3.*Assumption of Risk*: I/we understand that despite the resort's efforts, there are inherent risks associated with construction, creekside areas, swimming in Oak Creek and hiking on trails. I/we acknowledge that I/we are aware of these risks and assume full responsibility for my/our safety and well-being while on the Premises.
4.*Release of Liability*: I/we release and hold harmless Sedona Views B&B, its owners, officers, directors, employees, agents, and affiliates (the "Released Parties") from any and all claims, demands, or causes of action arising from any damage, loss, or injury to myself/ourselves or my/our property.
5.*Creekside and Hiking Trail Use*: I/we understand that the creekside area and hiking trails may pose additional hazards, including but not limited to slippery rocks, fast-moving water, wild animals and uneven terrain. I/we acknowledge that I/we are aware of these risks, including crossing between properties on highway89A and I/we assume full responsibility for my/our safety while using these areas.
6.*Indemnification*: I/we agree to indemnify and hold harmless the Released Parties from any and all claims, demands, or causes of action arising from my/our use of the Premises.
7.*Governing Law*: This waiver shall be governed by and construed in accordance with the laws of the State of Arizona.
